Supreme Court ordered deletion of 'adult male' from DV Act 2005

 

 

Supreme Court made adjustment in Domestic Violence Act, deleted adult male from the act

Supreme Court has ordered to make some adjustments regarding the Domestic Violence Act, 2005.

Two words ‘adult male’ will be deleted from the act which signifies that any women or any non-adult will be prosecuted against any violence or harassment.

Statement of the act as it disrupted the Right to Equality

Under the Domestic Violence Act, Section 2 (q) states that respondent means any adult male person who is, or has been, in a domestic relationship with the agreed person and against whom the agreed person has sought any relief under Domestic Violence Act’.

But supreme Court has ordered to made some adjustments and ordered for deletion of the words ‘adult male’ from the statute book saying that it disrupted the Right to Equality under the constitution.

The bench said that the 'adult male person' are different to the object of affording protection to the women who have suffered from domestic violence of 'any kind'.
