National Judicial Appointments Commission History, Features, Act Details

 

 

The NJAC Act and the Constitutional Amendment Act came into force on 13th April 2015.

The NJAC is set to replace the Collegium System of appointment of Judges to the Supreme Court and the High Court by a Commission comprising the CJI, 2 senior SC judges, the Union Law Minister and two eminent persons

At present, the validity of the NJAC is being examined by a 5 member bench of the Supreme Court of India and the Government has mounted pressure on the 5 member bench to transfer the case to a 9 or 11 member bench. This is being done as the Collegium Case was heard by a 9 member bench of the Supreme Court

Indeed through PILs, Judicial Activism and the use of the Writ Mandamus, the Indian Judiciary has played an active role in delivering Justice to the people.

However, the Collegium system was not without ills. The Collegium System had been accused of not being transparent and not having the time to appoint judges through a proper process.
