HIV AIDS Act 2017 Features, Rights of HIV Patient in Property and Medical Treatment

 

 

Ministry of Health confirms the implementation of HIV/ AIDS Act 2017 from 10th September 2018

Notification of HIV / AIDS Act, 2017 has been issued by the Union Health Ministry. It has been informed in the notification that since 10th September 2018 it has been implemented in the whole country.

Victims may gain the benefits of this act for their benefit. At the same time, after the enactment of the Act, HIV / AIDS victims will be able to get all rights in the property and all possible assistance related to health services. It has been clarified in the Act that discrimination against such patients will be considered as a crime category.

This Act empowers HIV sufferers to remain with the family and prevents them from discriminating against them and spreading hatred.

Under this act, the patient has been given the judicial authority of anti-retroviral therapy, according to which every HIV patient will get right of HIV Prevention, Testing, Treatment and Counseling Services.

In this Act, the State and Central Government have been given the responsibility to help prevent and prevent appropriate infections in HIV sufferers.

State governments have also been asked to start welfare schemes for these patients.

No patient can be compelled for the HIV test or any medical treatment without his consent.

An HIV positive person will be forced to reveal his status only when a court order will be made for it.

It has also been said that the consent of the licensed blood bank and medical research will not be required unless the HIV status of that person is made public.
