Allahabad high court in favour of public,can take land for public

 

 

Allahabad High Court states religious land can be utilised for public use

The Allahabad High Court declared that government can take over the land where religious prayers are conducted and convert it for the benefit of the public.

The decision taken by the bench comprising of Justice VK Shukla and Justice MC Tripathi

The petitioner filed and was of the view that NHAI has acquired land for the construction of Agra-Etawah bypass and the land of the church has been acquired.

The Places of Worship Act, 1991 states that it is prohibit for conversion of any place of worship and for the maintenance of religious character.

However, the bench rejected the petitioner and was of the view that law put restrictions on conversion of place of worship of one community or section into religious place of another community.
