Justice Kurian Joseph and Justice Rohinton Nariman rejected Jammu and Kashmir’s view that the constitution of Jammu and Kashmir is not equal to constitution of India.
The Supreme Court snugs Jammu and Kashmir High court asserting the sovereignty and sovereign powers and states that Jammu and Kashmir High Court has no sovereignty outside the constitution of India.
The bench of Justice clarified that the residents of Jammu and Kashmir are first and foremost the citizens of India and there is no dual citizenship as it is contemplated by other federal constitutions of the World.
Supreme Court stated that Article 1 of Constitution of India and Section 3 of Jammu and Kashmir Constitution makes it clear that India shall be United of States and Jammu and Kashmir shall be integral part of Union of India.
