Trademark refers to a graphical representation of goods or services to make it distinguishable from others. It can be words, symbols, sound, colors, shape of goods, graphics representation or packaging etc. It protects the owner against unfair competition, prevents damage to the reputation of the owner and consumer welfare.
Trademark is denoted by 'TM'.
Trademarks are divided into 42 international classes, each class representing similar goods or services. Whereas a trademark may be registered under multiple classes, it is protected only in the class(es) relevant to the business or trade area of the item. And, whereas the use of symbol 'TM' does not provide any legal benefit, it precludes the infringer's defense of lack of knowledge of a trademark claim.
Indian Trademark: In India, trademarks are governed under Trademarks Act, 1999 ( it deals with precise nature of rights one can acquire in respect of trademarks), under the aegis of Department of Industrial Policy & Promotion (DIPP), Ministry of Commerce. The implementing body is the Controller General of Patents, Designs, and Trademarks.
Mumbai’s Taj Mahal Palace hotel was the first building in India to acquire image trademark under the Trademark Act of 1999 in June 2017.
